Property Settlements Attorney in Baytown, Texas
Property Settlements Under the Community Property Laws in Texas
When your marriage comes to an end in Texas, one of the most challenging issues to resolve can be the division of marital debts and assets. Property Settlement Attorney Linda Stewart has over eight years of experience with property division in Texas. Under Texas law, all property acquired or accumulated during the marriage is considered community property (with limited exceptions), and must be divided equally in a divorce. What happens if there are complex property holdings, from real estate to investments or retirement funds? How do you put value on a family-owned business without selling the business? Attorney Linda Stewart can help. And, quite often, however, people have acquired some separate property before their marriage, or by gift or inheritance during the marriage. We will help characterize and protect that property for you while helping you toward a just and right property division.

Our Property Division Practice
When you hire us to help you resolve property issues under the community property laws in Texas, we will start by compiling an inventory of the debts and assets of your marriage. We will then determine which assets are the separate property (either brought into the marriage or excluded under Texas law) and what assets are community property. Once we have determined what items are community property, we will take the necessary steps to verify fair market value. We will work with experts, when necessary, including business and real estate appraisers, forensic accountants, and others.
We will gather, evaluate and preserve all evidence to support your position, and will represent you in all hearings or proceedings. We will also file all pleadings or other documents required by the courts.
